Abstract

In this study, we examined the subject of "the extension of copyright to third parties and the legal mechanisms for its protection"—a topic of paramount importance within intellectual property laws and related legislation, designed to safeguard intellectual output across various fields. We defined copyright and its legal nature by reviewing diverse scholarly perspectives, and explored the characteristics of this right, specifically the extent to which economic and moral rights may be transferred to others following the author's death. We highlighted the distinctions between economic and moral rights regarding their transmissibility to heirs, as well as the limitations surrounding such transfers. Furthermore, we addressed potential infringements of these rights, the resulting civil and criminal legal consequences, and the provisional or precautionary measures available to protect copyright against any violations or unauthorized use of an author’s works..
